Filing A Petition For Divorce In Singapore?

By Helen Marquez

A petition for divorce is usually filed by a spouse to terminate the marriage and settle important issues through court proceedings. The court proceedings would be less stressful if there are no properties or debts to be distributed to each party, there are no children, and the marriage is relatively short. Moreover, both parties would reach agreeable solutions if they both sign the petition without feeling hostile towards one another. After all, a divorce is purposely done to minimize bitterness over the termination of marriage.

The person who filed the petition for divorce is called the plaintiff and the other party the defendant. Singaporean courts require the plaintiff to submit the Writ of Divorce, the Statement of Claims, and Statement of Particulars through the electronic filing system. If there are children from the marriage, a Parenting Plan should also be submitted.

The Statement of Claims contains the reason why the plaintiff is filing for divorce, such as adultery, intolerable behavior, and other grounds for divorce stated in the Women's Charter. The statement of Particulars, on the other hand, should give details that would help support the claim.

If both parties agreed to settle the issues through mediation, they may ask assistance from the Family Court at the Family Resolution Chambers. This procedure is known among divorce lawyers as Resolution Conference and it can be accomplished with the help of a Resolution judge or a mediator.

This option is a practical and convenient way of solving divorce issues. It also saves parties from going through a lot of stress that partners usually go through when they choose to deal with this matter through court proceedings.

There are times though wherein there's no other way for both parties but to do the divorce proceedings in court and seek the help of divorce lawyers singapore residents consider credible. This is especially true with complicated marriages where the parties involved own a business or the defendant is charged with a criminal offense. In this case, they may seek the help not only of lawyers for divorce but also of criminal lawyers Singapore residents would approach should they find themselves needing the services of these professionals.
